2. Purpose

This Legal Notice governs access to, browsing and use of the website owned by NURIA LABS SL, accessible under the domain getgescon.com (the "Website"), and the pre-contractual and contractual relationships arising from it.

Access to and use of the Website confer the status of user (hereinafter, the "User") and imply full and unreserved acceptance of each and every provision included in this Legal Notice, in the version published at the time of access. If the User does not agree with these terms, they must refrain from using the Website.

3. Terms of use of the Website

3.1 Access and registration

Access to the Website is free of charge, except for the cost of the telecommunications connection supplied by the access provider contracted by the User. Certain services or sections, in particular access to the Gescon platform hosted at https://gescon.nurialabs.com, require prior registration and acceptance of the specific Terms and Conditions governing use of the SaaS.

3.2 Proper use of the Website

The User undertakes to use the Website, its content and services in accordance with the law, this Legal Notice, morality, accepted standards of conduct and public order. The User further undertakes to make appropriate use of the services and not to use them to carry out unlawful activities, activities contrary to good faith or to the legal system, activities that are harmful to the rights or interests of third parties, or activities that could damage, disable, overload or impair the Website or prevent its normal use.

In particular, the User undertakes not to:

• Reproduce, copy, distribute, transform, modify or carry out any similar act in relation to the content of the Website without the express written authorisation of the Owner.
• Introduce or disseminate computer viruses, malicious code or any other element liable to cause alterations to the systems of the Owner or of third parties.
• Carry out scraping, unauthorised mass indexing or reverse engineering of the Website or the Gescon platform.
• Impersonate other users or use credentials belonging to others.
• Use the Website to send unsolicited advertising or any other form of communication for unauthorised commercial purposes.

4. Intellectual and industrial property

All content on the Website, understood to mean, purely by way of illustration, the texts, photographs, graphics, images, icons, technology, software, links, audiovisual or sound content, as well as its graphic design and source code, are the intellectual and industrial property of NURIA LABS SL or of third parties who have authorised its use, and no exploitation rights recognised by the legislation in force on intellectual property shall be deemed to have been assigned to the User in respect thereof.

The trademarks, trade names, distinguishing signs and, in particular, the names "Gescon" and "NURIA LABS", together with their associated logos, are the exclusive property of NURIA LABS SL or, where applicable, of third parties, and no right whatsoever over them shall be deemed to be granted to the User by the mere fact of accessing the Website.

The reproduction, distribution, public communication, transformation or any other form of exploitation, whether total or partial, of the content of the Website without the prior express written authorisation of the Owner is expressly prohibited. Any unauthorised use shall constitute an infringement of intellectual or industrial property rights and shall give rise to the liabilities established by law.

5. Links to third-party websites

The Website may contain links to other websites managed by third parties, with the aim of providing the User with access to information from collaborating or sponsoring companies. NURIA LABS SL accepts no responsibility for the content of such websites, nor for the technical availability, quality, reliability, accuracy, scope, veracity, validity or lawfulness of any material or information contained in any of those hyperlinks or other internet sites.

The inclusion of these links does not imply any recommendation, promotion, endorsement or agreement with the statements, content or services provided through them. Accordingly, NURIA LABS SL shall not be held responsible for the content of those pages, nor for the conditions of access to or use of them, nor for any damage or loss that the User may suffer as a result of accessing or using them.

6. Disclaimer of warranties and liability

NURIA LABS SL does not guarantee the availability or continuity of the Website's operation. Where reasonably possible, it will give advance notice of any interruptions to its operation. Nor does NURIA LABS SL guarantee the usefulness of the Website for the performance of any particular activity, or its infallibility, and in particular, although not exclusively, that Users will actually be able to use the Website, access the various pages that make it up, or access those pages from which the services are provided.

NURIA LABS SL excludes, to the fullest extent permitted by law, any liability for damages of any kind that may result from:

• The lack of availability, maintenance or effective operation of the Website or of its services and content.
• The presence of viruses or malicious or harmful programs in the content.
• Unlawful, negligent or fraudulent use, or use contrary to this Legal Notice.

The specific terms governing the provision of the Gescon SaaS service are set out in the corresponding Terms and Conditions of Use, which shall prevail over the provisions of this Legal Notice with respect to the contractual relationship between the Customer and NURIA LABS SL.

7. Personal data protection

The processing of personal data collected through the Website, including through the contact form and the demo request, is carried out in accordance with the provisions of the Privacy Policy published on the Website, which the User must read and accept before providing their data.

10. Applicable law and jurisdiction

This Legal Notice is governed entirely by Spanish law. For any dispute that may arise from access to or use of the Website, NURIA LABS SL and the User, expressly waiving any other jurisdiction that might apply to them, submit to the Courts and Tribunals of the city of Palma (Illes Balears, España).

However, if the User qualifies as a consumer under Spanish and European regulations, the special rules and jurisdiction applicable to consumers shall apply, and the User may bring proceedings before the Courts and Tribunals of their place of domicile.
